Welcome to House of Power Ministry International mobile application (the "App"). These Terms of Service ("Terms") govern your access to and use of the App provided by House of Power Ministry International ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

            Important: Please read these Terms carefully before using the App. Your use of the App constitutes your acceptance of these Terms and our Privacy Policy.
        

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, by sending you a notification. Your continued use of the App after such changes constitutes your acceptance of the modified Terms.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the App, you may need to create an account. You can register using:

Email address with OTP (One-Time Password) verification
Phone number with OTP (One-Time Password) verification
Guest/Anonymous mode (limited features)

We use a passwordless authentication system. You will receive a one-time code via email or SMS to verify your identity each time you sign in. We do not store passwords.

3.2 Account Security

You are responsible for:

Maintaining secure access to the email address or phone number associated with your account
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account
Ensuring that your account information is accurate and up-to-date

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

Violation of these Terms
Fraudulent, abusive, or illegal activity
Extended periods of inactivity
Any other reason at our sole discretion

If you wish to delete your account, please contact us at info@prophetfranciskwateng.com with your account details.

4. Acceptable Use

4.1 Permitted Use

You may use the App to:

Access church sermons and announcements
Make donations to House of Power Ministry International
View and listen to spiritual content (sermons, music, testimonies)
Save favorites and set reminders
Receive notifications about church activities
Submit feedback and support requests

4.2 Prohibited Conduct

You agree NOT to:

Use the App for any unlawful purpose or in violation of any applicable laws
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Post or transmit any content that is offensive, abusive, defamatory, obscene, or hateful
Harass, threaten, or intimidate other users
Attempt to gain unauthorized access to the App, other accounts, or computer systems
Interfere with or disrupt the App's functionality or servers
Use automated systems (bots, scrapers) to access the App
Reverse engineer, decompile, or disassemble the App
Remove, alter, or obscure any copyright, trademark, or other proprietary notices
Use the App to distribute spam, malware, or viruses
Collect or harvest personal information of other users without consent
Make fraudulent donations or payment transactions

5. Donations and Payments

5.1 Payment Processing

All donations made through the App are processed securely by Paystack, a third-party payment processor. By making a donation, you agree to Paystack's terms of service and privacy policy. We do not store your complete payment card information on our servers.

5.2 Donation Purposes

Donations can be made for the following purposes:

General Offering
Tithes
Building Fund
Missions and Outreach
Special Projects

5.3 Refund Policy

Important - Refund Policy:

All donations are final and non-refundable except in the following circumstances:

Duplicate transactions due to technical errors
Unauthorized transactions (must be reported within 30 days)
Processing errors by Paystack

To request a refund for eligible transactions, contact us at info@prophetfranciskwateng.com within 30 days of the transaction with your transaction reference number.

6. Content Ownership and Licensing

Content Rights Declaration:

House of Power Ministry International owns all rights, title, and interest in and to all audio and video streaming content available through this App, including but not limited to sermons, teachings, worship services, music, testimonies, live radio broadcasts (Heaven FM), live television broadcasts (Elijah TV), YouTube channel content (@prophetfranciskwateng), and other spiritual content ("Ministry Content"). We have the exclusive legal right to distribute, stream, and make available all Ministry Content through this App.

6.1 Ownership of Ministry Content

All Ministry Content available in the App is the exclusive property of House of Power Ministry International. Specifically:

Originally Created Content: All sermons, teachings, worship services, live radio broadcasts (Heaven FM), live television broadcasts (Elijah TV), and YouTube videos are produced by House of Power Ministry International, featuring our pastors, ministers, and congregation. We own all intellectual property rights to this content.
Broadcasting Channels: House of Power Ministry International owns and operates Heaven FM (radio), Elijah TV (television), and the YouTube channel @prophetfranciskwateng. All content broadcast on these channels is our exclusive property.
No Third-Party Content: This App does not include any third-party copyrighted materials without explicit written permission. All content is either originally created by House of Power Ministry International or used under proper licensing agreements where applicable.

We affirm that we have obtained all necessary rights, permissions, licenses, and authorizations required to stream, distribute, and make available all Ministry Content through this App. No content in this App infringes on any third-party intellectual property rights.

6.2 Developer Authorization

Legal Authorization:

Leslie Narh (the "Developer" or "Technology Provider") has been granted explicit legal authorization by House of Power Ministry International to:

Develop, manage, and publish this mobile application on behalf of House of Power Ministry International
Integrate, stream, display, and distribute all Ministry Content (including audio, video, sermons, livestreams, radio broadcasts, and television broadcasts) within the App
Access and embed content from House of Power Ministry International's owned platforms, including Heaven FM, Elijah TV, and YouTube channel @prophetfranciskwateng
Represent House of Power Ministry International in all technical and operational matters related to the App

The Developer operates under the direct authority and authorization of House of Power Ministry International and has full legal permission to distribute all Ministry Content through this App. This authorization is documented and can be provided to Apple Inc. or other relevant authorities upon request.

6.3 License to Use Content

User License: By using this App, House of Power Ministry International grants you a limited, non-exclusive, non-transferable, revocable license to access and view Ministry Content solely for personal, non-commercial, spiritual enrichment purposes. This license does not grant you any ownership rights to the Ministry Content.

Developer License: House of Power Ministry International grants Leslie Narh (Developer/Technology Provider) a perpetual, worldwide license to stream, display, distribute, and make available all Ministry Content through this App and related platforms for the purpose of fulfilling the ministry's mission and reaching its congregation and community.

6.4 Third-Party Services

The App integrates with certain third-party platforms solely for the purpose of delivering Ministry Content that is owned by House of Power Ministry International:

6.4.1 YouTube Integration

The App embeds video content from YouTube. All YouTube content accessible through the App is:

Uploaded to and owned by House of Power Ministry International's official YouTube channel (@prophetfranciskwateng)
Content for which House of Power Ministry International holds all necessary rights and permissions
Embedded in compliance with YouTube's Terms of Service and Embedding Policies

Important: When you view YouTube content through this App, you are subject to YouTube's Terms of Service (https://www.youtube.com/t/terms) and Google's Privacy Policy (https://policies.google.com/privacy). The App does not download, store, or redistribute YouTube content outside of YouTube's permitted embedding methods. We do not provide access to third-party YouTube channels or content owned by other parties.

6.4.2 Stream Hub Africa Integration

The App integrates with Stream Hub Africa as a streaming infrastructure provider to deliver our live broadcasts:

Heaven FM (Live Radio): Our owned and operated radio station, streamed via Stream Hub Africa's platform infrastructure
Elijah TV (Live Television): Our owned and operated television channel, streamed via Stream Hub Africa's platform infrastructure

Stream Hub Africa serves solely as the technical streaming infrastructure provider. House of Power Ministry International owns all content broadcast on Heaven FM and Elijah TV. We have all necessary broadcasting licenses, rights, and permissions to operate these channels and stream their content through our mobile application. We do not provide access to other radio stations, TV channels, or content on Stream Hub Africa's platform that we do not own or have authorization to use.

6.5 Prohibited Use of Content

Unauthorized Use Prohibited:

You are expressly prohibited from engaging in any of the following activities with respect to Ministry Content:

Copying, reproducing, downloading, or capturing any audio or video content from the App for any purpose other than personal, non-commercial viewing/listening
Modifying, creating derivative works, or altering any Ministry Content
Distributing, republishing, broadcasting, or making available Ministry Content on other platforms, websites, or applications without explicit written permission from House of Power Ministry International
Using Ministry Content for commercial purposes, including but not limited to selling, licensing, or monetizing the content
Removing, altering, or obscuring any copyright notices, watermarks, logos, or proprietary markings from Ministry Content
Claiming ownership of or misrepresenting the source of Ministry Content
Circumventing any technological measures designed to protect Ministry Content

Any unauthorized use of Ministry Content may result in immediate termination of your access to the App and may subject you to legal action for copyright infringement and other violations of intellectual property rights.

6.6 Copyright and Trademark Protection

All Ministry Content, including sermons, teachings, music, graphics, logos, live radio broadcasts (Heaven FM), live television broadcasts (Elijah TV), YouTube videos, and other materials, is protected by:

Copyright laws of Ghana and international copyright treaties
Trademark laws protecting our ministry name, logos, and branding
Broadcasting rights and licenses for Heaven FM and Elijah TV
Other applicable intellectual property laws and regulations

The names "House of Power Ministry International," "Heaven FM," "Elijah TV," our logos, and all related marks are trademarks or registered trademarks of House of Power Ministry International.

7. Intellectual Property Rights

7.1 Our Content and Software

All content in the App, including but not limited to text, graphics, logos, images, audio clips, video clips, sermons, software, and user interface design, is the property of House of Power Ministry International or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License to Users

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use the App for personal, non-commercial, spiritual enrichment purposes only
View and listen to sermons and spiritual content for personal edification only
Stream content within the App for personal viewing/listening only
Share links to our content through the App's built-in sharing features (links only, not the content itself)

This license does NOT grant you permission to:

Reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any content from the App
Download, record, capture, or store Ministry Content for any purpose (except where explicitly permitted by the App for offline viewing within the App only)
Redistribute or republish Ministry Content on other platforms, websites, social media, or applications
Remove, alter, or obscure any copyright notices, watermarks, or proprietary markings
Use Ministry Content for commercial purposes or public performance
Claim ownership of or misrepresent the source of Ministry Content

Any use of Ministry Content beyond the scope of this limited license requires explicit written permission from House of Power Ministry International.

7.3 Feedback and Support Requests

By submitting feedback or support requests to the App, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and adapt such feedback for the purpose of improving the App and our services.

You represent and warrant that:

You own or have the necessary rights to the feedback you submit
Your feedback does not violate any third-party rights
Your feedback complies with these Terms

7.4 Reporting Copyright Infringement

If you believe that any content in the App infringes your copyright, please contact us at info@prophetfranciskwateng.com with:

A description of the copyrighted work you claim has been infringed
A description of where the allegedly infringing material is located in the App
Your contact information
A statement that you have a good faith belief that the use is not authorized
A statement that the information in your notice is accurate

8. Third-Party Services and Links

The App integrates with and may contain links to third-party services, including:

YouTube: For streaming our ministry's own video content from our official YouTube channel
Stream Hub Africa: For streaming infrastructure to deliver our owned Heaven FM (live radio) and Elijah TV (live television) broadcasts
Paystack: For secure payment processing of donations
Firebase (Google Cloud Platform): For app infrastructure, authentication, and data storage
Twilio: For SMS delivery of authentication codes
AWS SES: For email delivery of authentication codes and notifications

These third-party services are used solely to support the functionality of our App and to deliver our own ministry content. We are not responsible for the content, privacy policies, or practices of these third-party services. Your use of third-party services is subject to their respective terms and conditions.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Limitations of Liability

9.1 "As Is" Basis

The App is provided on an "as is" and "as available" basis. While we strive to provide a reliable and secure experience, we cannot guarantee that the App will always be available, uninterrupted, or error-free.

9.2 Service Availability

We make reasonable efforts to ensure the App functions properly, but we cannot warrant that:

The App will be uninterrupted, secure, or error-free at all times
All defects will be immediately corrected
The App is completely free of viruses or other harmful components
All content and information will always be accurate or up-to-date

9.3 Limitation of Liability

To the extent permitted by law, House of Power Ministry International shall not be liable for indirect, incidental, or consequential damages resulting from:

Your use of or inability to use the App
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of the App's availability
Any technical issues, bugs, or errors in the App
Any errors or omissions in content provided through the App

We are committed to serving our community and will work with you in good faith to resolve any issues that may arise from your use of the App.

10.4 Spiritual Content Disclaimer

The spiritual content, sermons, and teachings provided through the App are for informational and inspirational purposes. They do not constitute professional advice (legal, medical, financial, or otherwise). You should consult appropriate professionals for specific advice tailored to your situation.

11. User Responsibilities

You agree to use the App responsibly and in accordance with these Terms. You agree to hold harmless House of Power Ministry International, its officers, directors, employees, and volunteers from any claims arising from:

Your misuse of the App
Your violation of these Terms
Your violation of any rights of another person or entity
Any fraudulent or illegal activity conducted through your account

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.

12.2 Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the App:

Informal Resolution: We encourage you to contact us first at info@prophetfranciskwateng.com to seek an informal resolution.
Mediation: If informal resolution fails, the parties agree to attempt to resolve the dispute through mediation before pursuing litigation.
Jurisdiction: If mediation is unsuccessful, any legal action shall be brought in the courts of Ghana, and you consent to the exclusive jurisdiction of such courts.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination:

Your right to use the App will immediately cease
We may delete your account and all associated data
You must cease all use of the App
Provisions that by their nature should survive termination shall survive (including ownership, warranty disclaimers, indemnity, and limitations of liability)

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and House of Power Ministry International regarding the use of the App and supersede all prior agreements and understandings.
